Climate change poses many challenges for BC local governments. Ironically, one such challenge stems from the wording of legislation intended to protect local governments from water claims. Section 744 of the Local Government Act (the “Act”) provides local governments with “immunity in relation to certain nuisance actions”. As the very heading of this section makes clear, the immunity is narrow in scope, restricted to those cases in which there has been a breakdown or malfunction of the water or sewer system.
